When do I need title insurance?
If you’re buying a home, title insurance is a policy that protects your investment, your property rights, and your lender's investment.
There are two different types of title insurance: an owner’s policy and a lender’s policy.
An owner’s policy is the best way to protect your property rights. Usually the buyer will pay for this policy. A lender’s policy is usually required by the lender and only protects the lender’s financial interests. The buyer typically pays for this policy as well.
Owner’s title insurance protects your investment in your property from certain future legal claims regarding ownership of your property. For a one-time fee, you receive coverage for as long as you own your home. The owner’s policy also covers potential legal fees and court costs for settling claims covered by your policy.
Why should I form a separate business entity for my business? (ie. corporation, LLC or LLP)
When choosing the correct type of entity for your business, numerous considerations come into play, including personal liability, ownership and management, cost of forming and registering the business, and taxation. Reasons you might want an LLC include:
- Limiting your personal liability for business debts
• With an LLC, only the assets owned in the name of the LLC are subject to the claims of business creditors, including lawsuits against the business
• The personal assets of the LLC members cannot be claimed to satisfy business debts. For most people, this is the most important reason to form an LLC
• Raising capital from investors. This can be done by bringing in other members who contribute funds, property, or services to the business
• Tax advantages. There is usually no separate tax levied on the LLC itself, as there may be with a corporation, therefore avoiding double taxation
• LLC profits or losses are generally passed on to the members, as they would be with a partnership
As a grandparent, what rights do I have to see my grandchildren?
Pennsylvania's Grandparent Visitation Act has withstood constitutional challenges. In Pennsylvania, a grandparent can seek visitation (also called partial custody) if the child's nuclear family unit is broken. Specifically, a grandparent can file an action for partial custody when:
• The child's parent(s) is deceased
• The child's parents have been separated for at least six months or have filed a divorce or separation action or the child has resided with the grandparent for at least 12 months.
Additionally, even if the above factors are present, the grandparent must demonstrate that partial custody or visitation serves the grandchild's best interests and doesn't interfere with the child-parent relationship.
How does filing a bankruptcy help me solve my financial problems?
If you decide to move forward with a personal bankruptcy proceeding, you'll have to decide under which chapter to file: Chapter 7 or Chapter 13.
Both types of bankruptcy can help you eliminate unsecured debt (such as credit cards), halt a foreclosure or repossession, and stop wage garnishments, utility shut-offs and debt collection actions.
With both types, you'll be expected to pay your own court costs and attorney fees. However, the two types of bankruptcy relieve debt in different ways.
